Clarification Text Regarding the Processing of Commercial Electronic Messages

This document has been prepared to inform you about the processing of your personal data under Article 10 of the Law on the Protection of Personal Data No.6698 (“KVK Law”) and the Communiqué on the Procedures and Principles to be followed in the Fulfillment of the  Obligation of Informing.

EB Rebosio Ltd. Şti. (“Our Company” or “EB Rebosio“), residing at the address Filistin Sok. No: 14/5, 06700 GOP, Ankara, TURKEY, process your personal data as the data controller following the KVK Law and relevant legislation within the scope described below.

a) Our Purposes of Processing Your Personal Data

Your personal data are processed following the principle of commitment to purpose, with limited, measured, specific, clear, and legitimate objectives, under the law and honesty rules. Besides, our Company takes the necessary care to keep the personal data it processes accurate and up to date. In this context, your personal data can be processed for the following purposes.

Our Company may need your open consent while processing your personal data in some of its activities. We can process your identity information, contact information, and marketing information to carry out the marketing of the products and services offered by our Company to our customers and potential customers and to make plans for you to obtain the highest benefit,  to inform you about special opportunities for our products and services, to carry out promotional and advertising activities, and to manage customer satisfaction and loyalty activities.

b) Transfer of Your Personal Data

Your personal data, especially contact information, may be transferred to our suppliers and business partners, from whom we receive service for the purposes specified above, and authorized public institutions and private persons to fulfill our legal obligations for the reasons stipulated in the laws.

c) The Method of Collecting Your Personal Data and Legal Background

Our Company collects your personal data through physical and electronic media, including e-mail, telephone, SMS, and other devices, to fulfill the purposes mentioned above most practically and effectively based on the legal reasons; based on the open consent you have expressed as stated in Article 5/1 of the KVK Law and if the information has been made public by the related person as specified in Article 5/2 (d) of the KVK Law.

 

d) Storage of Your Personal Data

Your personal data can be stored for the periods required by the purposes of the processing. Within the scope of the fulfillment of the legal obligation of the Company, article 5/2 (ç) of the KVK Law, if you refuse to receive commercial electronic messages or commercial electronic communication, our Company, our business partners, and our suppliers can keep your personal data for 3 years, unless there is no reason to keep your personal data for longer periods from the date of rejection. Your personal data whose processing purposes are no longer valid are deleted, destroyed, or anonymized unless there is no other justification or a legal basis, there is no standard retention period stipulated in any legislation, there is no international law or regulation, and the obligations arising from contracts are eliminated.

e) Your Rights Regarding Your Personal Data

As the data owner, you have the following rights regarding your personal data Under Article 11 of the Law:

• Learning whether your personal data is processed,
• If your personal data has been processed, requesting information about it,
• Discovering the purpose of processing your personal data and whether they are used appropriately for their purpose,
• To know the third parties to whom your personal data is transferred domestically or abroad,
• To request correction of your personal data if it is incomplete or incorrectly processed, and to request notification of the transaction made within this scope to third parties to whom your personal data has been transferred,
• To request the deletion or destruction of your personal data and to notify the third parties to whom your personal data has been transferred if the reasons for its processing disappear, even though it has been processed under the provisions of the Personal Data Protection Law No 6698 and other relevant laws,
• Object to the occurrence of a result against you obtained by analyzing the processed data exclusively through automated systems,
• To request compensation for the damage if you suffer damage due to unlawful processing of personal data.

You can submit your requests regarding these rights by filling out the Application Form on our website. You can send them to our Company by including the mandatory matters under the Communiqué on Application Procedures and Principles to the Data Controller, by using a written or registered electronic mail (KEP) address, secure electronic signature, mobile signature, or your e-mail address previously notified by you to our Company and registered in our Company’s system. Your application will be answered free of charge. However, if the requested transaction requires additional costs, the fees in the tariff determined by Personal Data Protection Board  will be requested from the applicant.

TEXT OF OPEN CONSENT ON SENDING COMMERCIAL ELECTRONIC MESSAGES

Within the scope of your open consent, we can process your personal data for purposes such as carrying out the marketing processes of the products and services offered by our Company and making plans for you to get the highest benefit, offering you special opportunities for our products and services, and conducting promotional and advertising activities.

Your personal data can be shared with third-party companies from which we receive services at home or abroad to execute business activities and if required by the employment contract.

İNCEK HOSPITAL ELECTRONIC MESSAGE APPROVAL

This text includes my consent within the scope of 6563 Law on Regulation of Electronic Commerce and Regulation on Commercial Communication and Commercial Electronic Messages regarding                EB Rebosio Ltd. Şti. (“EB Rebosio”) to announce general/special opportunities about the products and services offered by them, to inform of current developments, to send messages for celebration purposes, to share content such as presentations and bulletins, to send commercial electronic messages and other messages under the relevant laws for promotion and advertisement, that my contact information, identity information, marketing information are received for these purposes to carry out the sales of goods/services and advertising/campaign/promotion processes, and messages will be sent to me via the channel I prefer, that I will always be able to change my communication preferences or stop the communication by refusing the process specified in the messages received by me without any justification, and in accordance with the law, to send me commercial electronic messages and other messages through SMS/text message, automatic call, telephone call, social media and online advertising networks, e-mail/mail and other electronic communication tools-channels.

I accept and declare that I have read and understood the above Clarification and Open Consent Text regarding commercial electronic messages to be sent to me, and I approved this text. In this context, I give open consent and approval to send commercial electronic messages to me through the channels I prefer below.
